BNDES Exim Automático: uma análise à luz da legislação estrangeira

Abstract

O presente artigo sistematiza o resultado da consulta feita pela Área de Comércio Exterior (AEX) do BNDES a escritórios de advocacia estrangeiros a respeito da viabilidade operacional do BNDES Exim Automático em países da América Latina e África. A pesquisa teve por objetivo analisar a legalidade das estruturas operacionais inicialmente idealizadas para o BNDES Exim Automático, à luz do ordenamento jurídico dos países em que localizadas instituições financeiras com maiores perspectivas de parceria operacional com o BNDES. Com base nos pareceres legais emitidos, foram selecionados os aspectos mais relevantes da legislação estrangeira consultada para serem retratados neste artigo, com destaque para as peculiaridades legislativas que impõem a adequação das modalidades operacionais do BNDES Exim Automático ou mesmo inviabilizam sua adoção nos países-alvo.

The purpose of this study is to organize and codify the results of a consulting carried by the Export Credit Division of BNDES to foreign law firms, regarding the operational feasibility of the BNDES Automatic Exim in countries of Latin America and Africa. The scope of this research was to analyze the legal character of the operational structures formerly conceived to the BNDES Automatic Exim, given the laws of the countries in which financial institutions offer better perspectives for an operational partnership with the BNDES. The most relevant aspects of the foreign legislations were selected from the issued legal opinions, and are here depicted, with emphasis on some legal peculiarities that demand changes on the original BNDES Automatic Exim program, or even make its use unfeasible on the targeted country.
