A política, o direito e a incerteza

Abstract

O objetivo deste artigo é demonstrar a complexa interação que existe entre o direito e a política por meio da análise conceitual e histórica das diferentes teorias que tentam modelar e entender a atividade judicial. Pretende-se apresentar os elementos que influenciam a tomada de decisões na atividade judicial, pela ótica dos incentivos internos e externos que levam os juízes a decidir como decidem, para quebrar o paradigma do direito reduzido ao que está na lei. Com base nesse quadro, será explicado porque as pessoas não familiarizadas com o direito precisam compreender a atividade jurídica de forma distinta da usual, mais próxima da lógica de um gestor de riscos e menos focada na lógica binária do certo/errado.

The purpose of this paper is to demonstrate the complex relation between law and politics, from the perspective of the global expansion of the judicial power. The idea is to present the different models that study the judicial behavior, to change the current perception that legality is the only element of a judicial decision. From that point, we are going to explain why the legal activity must be understood in a different perspective than it usually is, less focused in a right or wrong perspective.
